In a nine-page decision issued Monday, acting State Supreme Court Justice Denis R. Hurley ruled that Shirley Chusit, who has been a patient at the West Brentwood hospital for more than 40 years, should receive radiation therapy first, before considering removal of her left breast. Last month, Pilgrim, saying that Chusit has been a ward of the state and incompetent to make a meaningful decision on her treatment, sought a routine court order to have the mastectomy performed. But Chusit's daughter, Sonia Schwartz, an artist from Teaneck, N.J., challenged the hospital's application, claiming that she was not consulted in time, and that doctors failed to explore other options before recommending breast removal.
